1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between you and Dofo Teknoloji Anonim Şirketi, doing business as Deepinfo. By accessing or using the Deepinfo platform, API, or any associated services (collectively, the "Services"), you agree to be bound by these Terms.
2. Service Description
Deepinfo provides a Continuous Threat Exposure Management platform comprising the following modules: External Attack Surface Management (EASM), Cyber Threat Intelligence (CTI), Brand Risk Protection (BRP), Third-Party Risk Management (TPRM), and Deep Search & Insights (DSI), together with associated Data Feeds and API Services. Services may be accessed via the web application, API, and integrations as described in your subscription.
3. Accounts and Authentication
You are responsible for maintaining the confidentiality of your account credentials and API keys. You must notify Deepinfo promptly of any unauthorized use of your account. Deepinfo is not liable for loss or damage arising from failure to maintain adequate credential security.
4. Payment and Billing
Subscription fees are payable in advance according to your chosen billing cycle. All fees are non-refundable except as expressly provided in these Terms or required by applicable law. Pricing changes for renewing terms will be communicated with advance notice as defined in your order.
5. Acceptable Use
You may not use the Services to: (a) scan, probe, or monitor infrastructure you do not own or have explicit authorization to assess; (b) violate applicable law; (c) infringe any third-party rights; (d) attempt to reverse-engineer the Services; or (e) use the Services to provide competing commercial services.
6. Customer Data
You retain ownership of all data you provide to or generate through the Services ("Customer Data"). You grant Deepinfo a limited license to process Customer Data solely for the purpose of providing the Services. Deepinfo's Data Processing Agreement, available on request, governs the processing of personal data.
7. Intellectual Property
The Services, including all software, documentation, and content other than Customer Data, are and remain the exclusive property of Deepinfo. These Terms do not transfer any intellectual property rights to you except the limited right to use the Services during your subscription term.
8. Confidentiality
Each party agrees to maintain the confidentiality of the other party's non-public information disclosed in connection with the Services, and to use such information solely for purposes contemplated by these Terms.
9. Warranties and Disclaimers
Deepinfo warrants that the Services will perform substantially in accordance with our published documentation. EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEEPINFO'S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO DEEPINFO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. IN NO EVENT SHALL DEEPINFO BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify and hold Deepinfo harmless from any claims arising from your violation of these Terms or your use of the Services in violation of applicable law or third-party rights.
12. Termination
Either party may terminate these Terms for material breach by the other party that is not cured within 30 days of written notice. Upon termination, your right to access the Services ends, and Customer Data is handled per the retention timelines set out in our Data Processing Agreement.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of laws principles, except as otherwise required by applicable law for customers resident in the European Union. Disputes shall be resolved by the competent courts in the jurisdiction of Deepinfo's registered office, unless otherwise mandated by applicable consumer protection law.
14. Changes to These Terms
Deepinfo may update these Terms from time to time. Material changes will be communicated with at least 30 days' advance notice. Continued use of the Services after the effective date of an update constitutes acceptance of the revised Terms.
